Telecommunications products for use or sale in Brazil are required to go through the homologation process by the National Telecommunications Agency – ANATEL to become regularized and legalized. This regulation was established and approved by Resolution nº 715, based on federal law No. 9,472.

The lack of approval of the product makes it irregular and illegal to use and sell and may lead to retention of the imported product, sealing of lots, and fines by ANATEL.

Consumers and users who purchase or already use products approved by ANATEL, have a guarantee of quality, technical features, and regulated safety, with rational and efficient use of the radioelectric spectrum, providing the proper functioning of all the equipment present in that environment of use.

ANATEL’s homologation process for products sold in the Brazilian market follows the certification models presented below:

⦁ Certification based on Type Testing:

(Type 1a certification scheme)
In this model, the type approval certificate will be issued based on the evaluation, conformity of the documentation, and test reports. The maintenance step of the approval and the Manufacturing Management System does not apply to this model.

⦁ Certification based on Type Testing with Periodic Product Evaluation:

(Type 4 certification scheme)

In this model, we have the same conditions as the model described above, only with the inclusion of the maintenance step. The Manufacturing Management System step does not apply to this model.

⦁ Certification based on Type Test with Periodic Evaluation of the Product and the Manufacturing Management System:

(Type 5 Certification Scheme)

In this model, we have the same conditions as the model described above, now with the inclusion of the Manufacturing Management System.

The process is summarized in the following five steps:

Stage 1: Classification

Corresponds to the sending of the product’s technical information for the correct framing of the norms, definition of the test list, document guidelines, preparation of the samples, and finally the planning of the entire process.

Stage 2: Laboratory testing

Product samples must be supplied to Brazilian laboratories authorized by ANATEL to perform tests. In some cases, it is possible to use existing test reports, but only after analysis of the prerequisites.

Stage 3: Certification by the OCD

Consists of sending documents related to the product, such as technical/productive characteristics and information related to the company that represents it in the market.
With this, the agency accredited by ANATEL evaluates the test reports and the process documents, issuing the Certificate of Compliance or Non-Compliance (pending technical and/or documentary issues) to be resolved.

Stage 4: Homologation by Anatel

The National Telecommunications Agency evaluates the whole process that was submitted in its system and issues the homologation, allowing the commercialization or the requirement (technical and/or documentary pending issues) to be solved.

Stage 5: Maintenance

The homologation must be sent for periodic conformity evaluations. This is a comparative process with the current standard, a shorter list of documents, and the possibility or not of new tests.

If the maintenance is not carried out within the expiration period, the homologation is suspended and the commercialization of the product must be interrupted, being necessary for the regularization within 180 days. Otherwise, the approval is canceled.

How do I know if my product needs ANATEL approval?

All equipment that transmits some type of radio frequency, that connects to the telecommunications network in a wired way or that is a critical component for telecommunications systems must be approved by ANATEL.

We can list the following product examples:

⦁ Devices with 2G, 3G, 4G, 5G, Wi-fi, Bluetooth technologies;

⦁ Devices with Lora Technologies, NB-IoT or proprietary technology;

⦁ Transmitters and transceivers of AM/FM or TV signals;

⦁ Chargers, batteries and power banks intended for cell phones;

⦁ Transmitters, transceivers, multiplexers and signal amplifiers;

⦁ Cables used for data transmission, such as optical, coaxial, UTP, STP and telephony cables;

⦁ Antennas used for data transmission;

⦁ Batteries used in telecommunications systems;

Anatel also defined, through the ATO 7280, the Reference List of Telecommunications Products that must be submitted to some form of conformity assessment.

The product I want to sell is already approved, do I need to do a new approval?

Anatel’s current regulation foresees some situations of assignment and sharing of the homologation.

Assignment is applied for situations of sale and incorporation of companies, where the homologation must be reissued in the name of the assignee.

Sharing, on the other hand, allows the approval to be used by more than one applicant through a contract between the parties, where there is a union of efforts with the commercialization of an already approved product.

Apart from these exceptions, the approval cannot be used by third parties without the proper authorizations. ANATEL also defined, through the ACT 4082, the considerations and formalizations on this subject.

My product is already certified in other countries, can I use this certificate in Brazil?

No. The certificate issued in other countries is not valid in Brazil. However, this already provides positive backing, since the product approvals and qualifications have been carried out.

Depending on the conformity assessment model indicated, some alternatives can be presented in the interest of cost and time reduction.
